Legal & Regulatory Policies

Applies to: Health System Link (“HSL”), its Health Insurance Risk Management System (HIRMS), websites, portals, and mobile applications.

These policies are drafted for board, regulator, insurer, and enterprise review and are aligned with POPIA (South Africa), HIPAA (United States), and GDPR (European Union), while remaining applicable globally.


TERMS & CONDITIONS OF WEBSITE USE

1. Introduction

These Terms and Conditions govern access to and use of the Health System Link website(s), web-based portals, and related online services (collectively, the “Website”). By accessing or using the Website, you agree to be legally bound by these Terms.

2. Eligibility & Authority

You warrant that:

  • You are legally competent to enter into binding agreements

  • Where acting on behalf of an organisation, you have the authority to do so

3. Permitted Use

The Website may be used solely for:

  • Lawful business purposes

  • Accessing authorised HSL services and information

  • Evaluating or operating the HSL HIRMS platform

4. Prohibited Conduct

Users shall not:

  • Interfere with system integrity, security, or availability

  • Misuse personal, medical, or confidential information

5. No Medical Advice Disclaimer

6. Availability & Maintenance

HSL does not warrant uninterrupted availability and reserves the right to suspend access for maintenance, security, or operational reasons.

To the maximum extent permitted by law, HSL shall not be liable for indirect, incidental, consequential, or special damages, including loss of data or business.

8. Governing Law

These Terms are governed by applicable national laws depending on the contracting jurisdiction, including but not limited to South African law where POPIA applies.

 

INTELLECTUAL PROPERTY POLICY

1. Ownership

All intellectual property in the HSL HIRMS platform, including software, workflows, databases, and documentation, remains the exclusive property of Health System Link or its licensors.

2. Restrictions

No rights are granted to copy, reverse engineer, modify, or distribute HSL intellectual property without written authorisation.

Health System Link maintains designated compliance and data protection oversight. Queries relating to privacy, security, or regulatory compliance may be submitted through official HSL support channels.
